A motion to get the sexual assault count dismissed and request to put the alleged victim on the stand in the John Joseph Daly case were denied at a hearing in Superior Court Tuesday morning.
Cochise County Superior Court Judge Timothy Dickerson held court Tuesday morning to hear arguments from Ralph Ellinwood, the attorney for Daly, who was requesting the court dismiss the sexual assault charge against his client. It was also requested that the court grant him the right to put the victim on the stand at the hearing in order to seek information from her about treatment she sought after reporting being assaulted in 2001.
His attorney said removing the sexual assault count would clear up what Daly is on trial for.….read full story (online subscribers only)
