The Bisbee City Council voted unanimously at their regular meeting Tuesday night to discontinue a contract with Unity Tiny Homes (UTH), the company that had entered into a purchase agreement for 17 acres in the San Jose area for the development of a tiny home community as part of the city’s affordable housing initiative.

City Planner Melissa Hartman, recommended to the council that they discontinue the contract due to breach by UTH, who entered into agreement to purchase the property on July 15, 2025.

UTH agreed to purchase the 17-acre Sierra Cobre Estates Subdivision for $125,000. Hartman told the council UTH made one payment towards the contract but only after she consulted with City Attorney Joe Estes and then reached back out to UTH letting them know payment was required or they would be in breach of contract. She said a few days later the city received a $25,000 payment towards the purchase price. Adding that since that payment in late January no other payments have been made despite assurances by UTH representatives
