A recent letter declining prosecution of a habitual offender in Bisbee who has broken into multiple homes and businesses some more than once will not be tried by the County Attorney’s Office.

According to a letter dated August 15, the state is declining prosecution on a recent break- in case because, “the suspect has previously been found to be not competent to stand trial and not restorable to competency.”

The decline in prosecution comes after the suspect was arrested by Bisbee Police officers for breaking into a home in June, a home which he had reportedly broke into three times
