Trial Delayed Again For Former BP Agent In 2001 Gym Club Cold Case

The trial for the retired Border Patrol agent charged with sexual assault and kidnapping in connection to a 2001 cold case that was brought back to life five years ago in May of 2021 after his DNA was linked to the case and cases in the Mesa-Gilbert area was delayed again after a last-minute motion to continue was filed hours before the trial was set to begin Tuesday, August 4, 2026.

The jury trial has been delayed twice already before Tuesday’s motion to continue in the case of retired Border Patrol agent John Daly III. The last-minute motion was filed in Cochise County Superior Court was posted to the court calendar about three hours before the trial was set to begin.

Daly was taken into custody in May 2021 after his DNA was matched to multiple cases involving sexual assault, kidnapping and abuse to include a Bisbee cold case in 2001 where a woman was attacked in her apartment.
